Terms of Service

These terms apply when you buy Stu, The Greedy Little Ant through this website. Placing an order means you accept them, so please read them first and keep a copy. They include a limit on our liability and an agreement to resolve disputes by individual arbitration, both set out below.

Who you are buying from

JSway, an independent author based in Florida, USA. Contact us at support@greedystu.com. We aim to answer within two working days.

Ordering

A contract is formed when we send your order confirmation. Very occasionally we may need to decline an order, for example if a price was shown incorrectly or a book is out of stock, in which case you are refunded in full straight away.

You must be at least 18, or have a parent or guardian order for you.

Prices and payment

Prices are in US dollars and are shown on the product page. Payment is taken by our payment provider on their secure checkout page; card details are entered there and never reach this website.

The price you pay is the one shown at checkout, including shipping and any sales tax that applies. Prices on the product page are shown before tax.

Delivery

• Printed books are dispatched from Florida within a few working days, and usually arrive within a week or two of that, depending on where you are. Those are estimates rather than guarantees. Shipping is charged once per order however many books are in it, and the amount is shown at checkout.
• The digital copy is emailed to the address on your order as a private download link that works for 30 days, so save the file somewhere safe when it arrives. If the link expires first, email us from the address you ordered with and we will send a fresh one at no charge.

We ship printed books within the United States only. The ebook has no such limit and can be bought and downloaded from anywhere.

Risk in a printed book passes to you on delivery. If a parcel is marked delivered but you cannot find it, tell us and we will help you trace it.

Returns and refunds

If something is wrong with the book. If a printed book arrives damaged, faulty, or is not what you ordered, email support@greedystu.com within 30 days of delivery and we will help. This is in addition to your legal rights.

If you change your mind. Return a printed book in resalable condition within 30 days of delivery for a refund of the book’s price. Return postage is yours to pay and the original shipping charge is not refunded. Email support@greedystu.com first so we can tell you where to send it; we cannot refund what we cannot trace.

Resalable means undamaged and unmarked. Ordinary careful reading is fine. A book that has been written in, torn, stained or has a broken spine cannot be resold, so we can offer only a partial refund or none, and we will tell you which before you send it.

The digital version. A file cannot be given back, so digital purchases are not refundable once the download link has been sent. Placing the order means accepting that. If the file will not open or never arrived, email support@greedystu.com and we will help.

Refunds go back to the card you paid with. How soon it shows up is down to your bank.

Fair use of these promises

Everything above is offered in good faith and we would rather be generous than difficult. Where there is clear evidence of abuse, such as repeated claims that do not stand up, returns of books that were never bought here, or download links being shared, we may decline a request, limit future orders, or close an account. We will always say why, and this does not affect any right you have by law.

Cancelling before it ships

Email support@greedystu.com as soon as you can. If the parcel has not gone out we will cancel and refund in full, including shipping. Once it is with the carrier it has to be handled as a return.

Copyright and what you may do with your copy

The story and every illustration are the property of Ah’Nay Satori (JSway) and are protected by copyright. Buying a copy gives you a personal, non-transferable license to read it, including aloud to children, a class, a library group or a story time.

It does not give you the right to:

• copy, print in bulk, or redistribute the file;
• share your download link, or upload the file anywhere others can reach it;
• resell, rent or sub-license any copy, digital or printed;
• create adaptations, translations, merchandise or derivative works;
• use the text or artwork commercially, or to train a machine-learning model.

Recording a reading for public broadcast, or posting one online, needs our written permission first. Please ask; we are glad to hear from teachers and librarians.

About the book itself

This is a children’s picture book, offered as a story. It is not educational, psychological or professional advice, and no particular outcome is promised from reading it.

Except for the guarantees written into these terms, and any rights you have by law that cannot be excluded, the book and this website are provided as they are, without further warranties of any kind, including implied warranties of merchantability and fitness for a particular purpose. Some states do not allow those exclusions, in which case they do not apply to you.

Our responsibility to you

We will supply the book with reasonable care and skill. Where the law allows us to limit our liability, our total liability arising out of any order is limited to the amount you paid for that order, and we are not liable for indirect, incidental or consequential losses, or for lost profits or data.

Nothing here limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited.

We are not liable for delays caused by events outside our reasonable control, such as carrier disruption, severe weather, supplier outages, or acts of government. If such a delay becomes unreasonable you may cancel and we will refund you in full.

The website

We try to keep this site available and accurate, but we do not promise it will be uninterrupted or error free, and we may change or withdraw any part of it. Prices and descriptions may be corrected at any time before your order is confirmed.

Nothing here removes your legal rights

You may have rights as a consumer under federal law, Florida law, or the law of the state or province where you live. Nothing in these terms takes those away. Where a term here conflicts with a right you cannot waive, that right applies and the rest of these terms continue in force.

If something goes wrong

Email support@greedystu.com first. Almost everything is fixable that way, and we would rather fix it than argue about it. We reply within two working days, and usually much sooner. Before starting any formal process, please give us 30 days from the day you first tell us about a problem to put it right.

Disputes

If we cannot resolve something between us, you and we agree that any dispute arising out of these terms or an order will be settled by binding individual arbitration, administered by the American Arbitration Association under its Consumer Arbitration Rules, seated in Florida or conducted remotely, rather than in court. Either of us may still bring an individual claim in small claims court instead.

Claims are brought individually. You and we both give up the right to take part in a class action, a collective arbitration, or a representative proceeding.

You can opt out. If you do not want this arbitration agreement to apply, email support@greedystu.com within 30 days of your first order and say so. Opting out costs nothing and changes nothing else about these terms.

Any claim must be brought within one year of the event it relates to, unless the law where you live requires longer. These terms are governed by the laws of the State of Florida, without regard to its conflict of law rules, and where a court is needed the courts of Florida have jurisdiction. If you live elsewhere, none of this deprives you of the protection of mandatory laws where you live.

General

• If any part of these terms is unenforceable, the rest continues to apply.
• Not enforcing a term on one occasion does not waive it later.
• These terms, with our Privacy Policy, are the whole agreement between us about your order.
• We may transfer our rights and obligations to another business without affecting your rights. You may not transfer yours without our agreement.
• Nobody other than you and us may enforce these terms.

Changes

We may update these terms. The version that applies to your order is the one published when you placed it, and the date at the top says when this version was written.
